1. Acceptance of Terms
By using the SysWatch service, you accept these terms and conditions. If you do not agree, do not use the service. The terms apply to all users, regardless of the chosen plan.
2. Service Description
SysWatch is a web server monitoring service that includes: uptime monitoring, SSL certificate verification, automated backups, package scanning, alerts and reports. The service is intended for business users (B2B) — web agencies, freelancers, IT companies.
3. Plans and Pricing
Starter Plan (€4.99/month): up to 2 servers, basic features. Pro Plan (€7.99/month): unlimited servers, all features. Agent Intervention (€29.99/incident): manual support per incident. Prices include VAT. Payment is processed monthly through Stripe.
4. Trial Period
We offer a 14-day trial period at no cost. No card details are required during the trial period. Upon expiry of the trial, the service is deactivated if no paid plan is selected.
5. Cancellation and Refund
You can cancel your subscription at any time from the control panel. Cancellation takes effect at the end of the current billing period. We do not offer partial refunds for unused periods, except in cases of error on our part.
6. User Obligations
You are responsible for: the security of your access credentials, the content of the monitored servers, compliance with applicable legislation, use of the service in accordance with its stated purpose. It is prohibited to use SysWatch to monitor servers without the consent of their owners.
7. Availability
We target 99.9% uptime for the SysWatch service. Planned maintenance is announced at least 24 hours in advance. We do not guarantee availability in cases of force majeure or events beyond our control.
8. Limitation of Liability
SysWatch is not responsible for: data loss caused by errors on monitored servers, indirect damages, loss of profit. Our maximum liability is limited to the amount paid in the last 3 months.
9. Intellectual Property
All intellectual property rights over the SysWatch service belong to StackFloww. You receive a non-exclusive, non-transferable licence to use the service during the subscription period.
10. Modification of Terms
We reserve the right to modify these terms. We will notify you by email 30 days before significant changes. Continued use of the service after changes constitutes acceptance of the new terms.
11. Governing Law
These terms are governed by Romanian law. Any disputes shall be resolved by the competent courts of Romania. For consumers, the provisions of EU consumer protection legislation apply.
